These Terms & Conditions form a binding agreement between you and Bimalu Recycling. They govern your use of bimalurecycling.com (the “Website”), access to the Bimalu staff portal, and the general basis on which Bimalu Recycling accepts, processes and pays for scrap metal and related materials. Please read them in full. If you do not agree with any part of these Terms, please do not use the Website.
1Definitions & interpretation
1.1 “Bimalu”, “we”, “us” or “our” means Bimalu Recycling, a metal recovery and preparation initiative operating in Lusaka, Republic of Zambia, operating together with related companies in the Bimalu group, including Bimalu Zambia Limited (bimaluzambia.com).
1.2 “Website” means bimalurecycling.com, including all pages, content, features and the staff portal interface.
1.3 “Staff Portal” means the restricted, login-protected part of our systems used by authorised Bimalu personnel to record and manage recycling, production, stock and dispatch operations.
1.4 “Materials” means any scrap metal, metal products, offcuts, dross, slag, foundry returns, alloys, e-scrap or other materials delivered, consigned or offered to us for recovery, purchase, processing or disposal.
1.5 “You” or “your” means any visitor to the Website, any supplier or potential supplier of Materials, and any user of the Staff Portal, as the context requires.
1.6 Headings are for convenience only and do not affect interpretation. Words importing the singular include the plural and vice versa. References to “including” mean “including without limitation”.
2About Bimalu Recycling
2.1 Bimalu Recycling recovers valuable metal from scrap and industrial by-products and prepares it for return to local manufacturing — supporting the production of locally made goods, including the cookware produced by Bimalu Zambia Limited.
2.2 Our operations include receiving and inspecting scrap, weighing and grading, melting and furnace preparation, recovery of offcuts and blanks, and dispatch of processed metal.
2.3 How to reach us: by email at sales@bimaluzambia.com, or at our facility in Lusaka, Zambia during normal working hours.
3Scope of these Terms
3.1 These Terms apply to: (a) your access to and use of the Website; (b) your access to and use of the Staff Portal; and (c) the general terms on which we receive and purchase Materials, unless superseded by a specific written contract signed by both parties.
3.2 The Website itself is an informational platform. Sales, purchases, deliveries and collections of Materials are concluded directly with our team at our facility or other agreed locations — not through checkout on this Website.
3.3 Where you also use websites of other Bimalu group companies (such as bimaluzambia.com), those websites are governed by their own terms and policies.
3.4 If any specific written agreement you sign with us conflicts with these Terms, that agreement prevails for that transaction.
4Website information & availability
4.1 Content on the Website is provided for general information about our operations, processes and contact routes. It does not constitute an offer, a quotation, professional advice or a guarantee of current prices, availability or capacity.
4.2 We make reasonable efforts to keep the Website accurate and up to date, but content may be incomplete, out of date or changed at any time without notice.
4.3 We do not guarantee that the Website will be uninterrupted, error-free or free of harmful components, and we may suspend, restrict or withdraw all or part of the Website for maintenance, security or business reasons.
5Eligibility & accounts
5.1 By using the Website or transacting with us, you confirm that you are at least 18 years old and, where you act for a company or another person, that you are properly authorised to do so.
5.2 Staff Portal accounts are created and approved by Bimalu management for authorised personnel only. Accounts are personal and must not be shared. You are responsible for keeping your username and password confidential and for all activity under your account.
5.3 You must notify us immediately if you suspect any unauthorised use of your account. We may suspend or revoke any account that is misused, compromised or no longer authorised, at any time and without prior notice.
5.4 We may refuse registration, access or service to any person at our reasonable discretion, to the extent permitted by applicable law.
6Selling & delivering Materials to us
6.1 Inspection and acceptance. All Materials are subject to inspection, grading and acceptance by our team at the point of receipt. We may reject any load, in whole or in part, before or after weighing.
6.2 Ownership and authority. You must be the lawful owner of the Materials or hold valid authority to sell them. We may require valid national identification (NRC or passport), company documents, a letter of authority, or other reasonable proof of ownership before accepting any delivery.
6.3 Prohibited Materials. We do not accept stolen or suspected-stolen Materials; hazardous, toxic or radioactive substances; sealed or pressurised containers; un-drained fuels, oils or chemicals; munitions; or any Materials whose possession or sale would be unlawful. Contaminated loads may be declined or surcharged for handling and disposal.
6.4 Suspicious deliveries. We keep the right to decline, hold or report any delivery, supplier or transaction that appears suspicious, unsafe or unlawful to the relevant authorities, without liability to you.
6.5 Weighing and grading. Weight is determined exclusively on our calibrated scales at receipt, in your presence where practical. Grading follows our internal specifications, which reflect metal content, contamination and market quality standards.
6.6 Pricing. Prices are linked to market rates, are quoted per tonne or kilogram as applicable, are confirmed at the time of acceptance, and may change between visits or deliveries without notice. Unless we state otherwise in writing, an indicative price is not binding until the Materials are accepted and weighed.
6.7 Payment. Where a purchase is agreed, payment is made against a weighbridge ticket or delivery record, to the verified seller, using our approved payment channels. Payment timing and any documentation requirements are confirmed at receipt.
6.8 Title and risk. Ownership of accepted Materials passes to us at the moment of acceptance, together with all risk. Once accepted, Materials cannot be returned, and no reclaimed, hidden or substituted items form part of the transaction.
6.9 Site rules and safety. While on our premises, you must follow all safety instructions, signage and staff directions, including any personal protective equipment requirements. Vehicles and loads must be roadworthy and secure. You enter our premises at your own risk to the extent permitted by law.
7Quotations, orders & supply of products
7.1 Any supply by us of processed metal, offcuts, blanks or other products is subject to a written quotation, order confirmation or contract agreed with you. Quotations are valid only for the period stated on them and are subject to stock and market availability.
7.2 Prices quoted are in Zambian Kwacha unless stated otherwise and may be subject to applicable taxes and levies. Delivery or collection terms, and the passing of risk and title for products we supply, are as stated in the applicable quotation or contract.
8Records & compliance
8.1 We maintain records of transactions, weights, suppliers and payments for operational, audit, safety and legal-compliance purposes, in line with our Privacy Policy.
8.2 You agree to provide truthful, complete and accurate information in connection with any transaction or account, and to update it where it changes.
9Acceptable use of the Website
You agree that you will not:
- use the Website or Staff Portal for any unlawful, fraudulent or misleading purpose;
- impersonate any person or misrepresent your affiliation with any entity;
- attempt to gain unauthorised access to any account, system, database or data, including by guessing credentials or exploiting vulnerabilities;
- scan, probe, test, scrape, harvest or systematically copy the Website, its content or its data without our prior written permission;
- introduce or attempt to introduce malware, viruses, or any code designed to disrupt, damage or obtain unauthorised access;
- interfere with the availability of the Website, including denial-of-service activity or unreasonable volumes of automated requests;
- use automated tools to create accounts, submit forms or interact with our systems;
- remove, obscure or alter any copyright, trademark or proprietary notice contained on the Website.
9.1 A breach of this clause is a serious matter. We may suspend or terminate your access immediately, report the conduct to law enforcement, and seek compensation for any loss caused.
10Intellectual property
10.1 All content on the Website — including text, layout, design, graphics, icons, code and data compilations — and all Bimalu names, logos and marks are owned by Bimalu or its licensors and are protected by copyright, trademark and other intellectual property laws in Zambia and elsewhere.
10.2 You may view, download and print pages for your personal, non-commercial reference, and share links to our public pages. You may not otherwise reproduce, republish, modify, translate, sell or exploit any part of the Website or its content without our prior written consent.
10.3 If you send us ideas, suggestions or feedback, you grant us a perpetual, royalty-free licence to use them without obligation or attribution.

11.1 The Website may contain links to third-party or group websites, such as bimaluzambia.com. Links are provided for convenience only and do not mean we endorse or control those sites.
11.2 We are not responsible for the content, availability, products, services or policies of any third-party website. Your use of them is at your own risk and governed by their terms.
12Disclaimers
12.1 The Website and all content are provided on an “as is” and “as available” basis, without warranties of any kind, whether express or implied, to the fullest extent permitted by law — including implied warranties of merchantability, fitness for a particular purpose and non-infringement.
12.2 We do not warrant that information displayed (including process descriptions or indicative prices) is complete, current or reliable for your purposes. Market metal prices fluctuate and any figures shown are illustrative unless expressly confirmed by us in writing.
12.3 Nothing on the Website constitutes legal, financial or technical advice for your specific situation.
13Limitation of liability
13.1 To the maximum extent permitted by the laws of the Republic of Zambia, Bimalu and its personnel will not be liable for any indirect, incidental, special, consequential or punitive loss, or for any loss of profit, revenue, business, goodwill, data or savings, arising from or connected to your use of, or inability to use, the Website.
13.2 Our total aggregate liability arising out of or in connection with the Website is limited to Zambian Kwacha 1,000 or the amount you paid us for access to the Website (which is ordinarily zero), whichever is greater.
13.3 Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation, or any liability that cannot lawfully be excluded under Zambian law.
14Indemnity
14.1 You agree to indemnify and hold harmless Bimalu, its management and personnel from and against all claims, losses, damages, costs and expenses (including reasonable legal fees) arising from: (a) your breach of these Terms; (b) your unlawful or negligent conduct; (c) Materials you deliver that you had no right to sell or that were contaminated or prohibited; or (d) your violation of any law or the rights of a third party.
15Privacy & data protection
15.1 We process personal information in line with our Privacy Policy, which explains what we collect, why, and your rights under the Data Protection Act No. 3 of 2021. That policy forms part of these Terms.
16Security & responsible disclosure
16.1 We take the security of our systems seriously. If you discover a vulnerability or security issue, please report it responsibly to sales@bimaluzambia.com so we can fix it. We ask you not to exploit, publicise or disclose any vulnerability until it has been resolved.
17Force majeure
17.1 We will not be liable for any delay or failure to perform caused by events beyond our reasonable control, including natural disasters, fire, flood, power or utility failures, internet or hosting outages, strikes, civil disturbance, war, government action, epidemics or market disruptions.
18Suspension & termination of access
18.1 These Terms remain in force while you use the Website. We may suspend or terminate your access (including Staff Portal access) at any time, with or without notice, for breach of these Terms, legal-compliance reasons, or business reasons.
18.2 On termination, clauses which by their nature should survive (including intellectual property, disclaimers, liability, indemnity and governing law) continue to apply.
19Changes to these Terms
19.1 We may amend these Terms from time to time to reflect changes in our operations, the law or technology. The “last updated” date and version number at the top of this page always identify the current version.
19.2 Your continued use of the Website after changes take effect constitutes acceptance of the updated Terms. Material changes will be highlighted on this page.
20Governing law & dispute resolution
20.1 These Terms and any dispute arising out of or in connection with them are governed by the laws of the Republic of Zambia.
20.2 Before starting formal proceedings, the parties will attempt in good faith to resolve any dispute by direct discussion for a period of thirty (30) days after written notice of the dispute.
20.3 Subject to clause 20.2, the courts of the Republic of Zambia have exclusive jurisdiction over any dispute arising from these Terms.
21Miscellaneous
21.1 Severability. If any provision of these Terms is held invalid or unenforceable, the remaining provisions continue in full force, and the affected provision is enforced to the maximum extent lawful.
21.2 No waiver. Our failure to enforce any provision is not a waiver of that or any other provision.
21.3 Assignment. You may not transfer your rights or obligations under these Terms. We may transfer ours in connection with a reorganisation or transfer of our business, with notice where practicable.
21.4 Entire agreement. These Terms and the Privacy Policy constitute the entire agreement between you and Bimalu regarding the Website and supersede all prior discussions or understandings on that subject.
21.5 Language. These Terms are written in English. Any translated version is for convenience only, and the English version prevails in case of conflict.
